Terms & Conditions

All our details mentioned in this website (www.chqxholidays.com) are sold subject to the Terms and Conditions (here in after referred to as an 'Agreement') with Chqx Holidays. Before booking/subscribing to and/or begin participating in the said 'Website'(www.chqxholidays.com), we believe that one has read, understood and accepted this 'Agreement'. If anyone does not agree to or wish to be bound by the 'Agreement', he/she may not access or otherwise use the said 'Website'(www.chqxholidays.com). We can only accept booking form signed as this confirms that you and other people on the tour accept our booking terms and condition and are entering into the contract. In respect of services like cruise, flights, coaches, sightseeing, transfers and allied ground handling facilities etc., of other operators including our business associates in India or outside India, the Terms and Conditions specified by such Operators, including their payment schedule, cancellation, refund etc. shall be applicable, in addition to our Terms and Conditions. ELIGIBILITY Persons, fulfilling the criteria set by relevant provisions of law relating to foreign exchange in India and the Reserve Bank of India Rules, whose passport is valid for at least six months subsequent to the date of departure of the tour and have been granted relevant visas to reach the point of commencement of the package travel and travel throughout, are eligible to book the packages with us. PASSPORT & VISAS To travel to India from overseas countries except for the citizen of Nepal & Bhutan, one needs a 06 months valid passport and a valid Visa. And processing of Passport and Visa are not included in the tour cost. EARLY CHECK-IN / LATE CHECK Ă¢€“OUT FROM HOTELS Please note that standard check-in / Checkout time in good hotels are 1200 Hrs. (IST). Therefore cost of Early check-in or Late check-out is not included in the tour cost. We can always make a request for early check-in or Late checkout if required but we do not guarantee that, that entirely depend upon the policy of the hotel, time of the year and availability of the room. MEALS Meals, wherever included in the package cost, shall be as per the standard menu of the hotel concerned. The Company, however, reserves the right to change the meal arrangement, if circumstances make it necessary to do so. The Company cannot guarantee a special meal / diet for the Client. If the Client misses or refrains from availing himself of any meal arranged by the Company due to his reasons, there shall be no refund. Where client makes a request in writing at the time of booking for a special meal / diet, company will make endeavour to arrange for the same; however, the Company shall not be held liable, if the same is not provided. HEALTH Any person who has a contagious disease is forbidden to travel, any person found during the tour with such a disease will be asked to leave the tour and will have to make their own arrangements to return home. INSURANCE We strongly recommend that you and all members of your party are covered by a policy of travel insurance. If you suffer from any disability or medical condition you must disclose this in advance to the insurance company. All insurance premiums are payable in full at the time of sale. RIGHTS TO AMEND ITINERARY Tour once commenced will strictly go as per the itinerary finalised. Amend, alter, vary or withdraw any tour package, holiday excursion or facility it has advertised or published or to substitute a service by service of similar class or type, if it is deemed advisable or necessary. In case of events and circumstances beyond our control, we reserve the right to change all or parts of the contents of the itinerary for safety and well being of our esteemed passengers. COMPLAINTS We do our best to give passengers travelling on any of our holidays, an enjoyable and trouble free holiday but occasionally plans go wrong. Should you have any complaint, please tell your Chqx Holidays Manger at the time who will do everything possible to resolve the matter immediately. If the situation is not resolved to your satisfaction, then you must notify the company within 28 days of the tour ending in writing. If you do not write to us within this time, this will affect the investigation and outcome of the complaint. Any disputes between clients and Chqx Holidays shall be governed by Jurisdiction on India. SURCHARGE The Price of your travel arrangement are subject to surcharges in case of sudden hike in fuel prices, schedule airfare and any taxes levied by the government. Even in this case, we will try to absorb an amount of 2%, amount exceeding over 2% will be surcharged. REVERSAL POLICY If you or any member of your party wishes to cancel your holiday, you must notify us in writing, in any case the date of cancellation will be at the date on which notice is received in the Tours Department of Chqx Holidays. The person who signed the booking form must also sign the letter of cancellation. As this incurs administrative cost and retention charges by hotel, the cancellation charges will apply on the following scale: A- Booking Policies Number of days before departure : Booking charges At the time of Booking : Rs. 1000/- or $ 17 per pax. to be paid on confirmation of the tour as booking fee. (Non-Refundable) 30 Days prior to commencement : 25% of the Tour Cost 10 Days prior to commencement : 75% balance of the Tour Cost For tours confirmed within 15 days of the tour commencement date : 100% payment in advance All flight /car/bus bookings are at customerĂ¢€™s risk. Chqx Holidays will not take any responsibility of this. However the service can be provided for which a service charge of 5% on the total amount would be payable (100% advance payment). You can also book your tickets online in www.tripservice.in. All the payment facilities are available. B- Cancellation Policy Number of days before departure : Cancellation charges More than 30 days : Rs 1000/- or $ 17 per pax will be retained as Cancellation Fee. 29Ă¢€“ 20 Days : 25% of the Tour Cost 19Ă¢€“ 10 Days : 50% of the Tour Cost 10Ă¢€“ 06 Days : 75% of the Tour Cost 05 Days or less : 100% of the Tour Cost In all prescribed peak season: any cancellation after booking NO REFUND. The decision of the management of Chqx Holidays (Chqx Holidays) will be final in all cases not covered by above mentioned guidelines. Liability The company does not own or control hotels, coach or other facilities mentioned in the tour. As an operator of the package tour therefore, we cannot be held liable. a) Where there has been no fault on the part of the company, supplier or agents. b) Where the failures in performance of the contract are attributable to the customer. c) Where the failures are attributable to a third party not connected with the provision of the holiday and are unforeseeable or unavoidable. d) Where the failures are due to unusual and unforeseeable circumstances beyond your control. e) Where the failures are due to an event which you or your supplier even with all due care could not foresee or foretell. Chqx Holidays accepts the liability for those arrangements for your holiday, which are wholly within our control and therefore, accept liability to clients for the negligence of our agents, which include our employees. However, we would like to draw attention to the following circumstances, which fall outside our direct control or where for some reason we are not prepared to accept liability. The various services comprising the tour packages are provided by independent entities that own or operate airlines, surface transportation, hotels, restaurants, kitchen caravans, caterers, ships and cruises, places of entertainment like theme parks, museums, art galleries etc. Though we endeavour to select reputed providers of such services, we have no control over such services or persons providing such services or their staff. We cannot, therefore, be held responsible, if the contemplated service is not provided by the supplier or there is a defect or deficiency in the services provided by any such supplier. FORCE MEJEURE Any act, omission, default of any independent contractor or other person or by any servant or agents employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person travelling with him howsoever caused. Chqx Holidays are unable to take liability for commercial arrangements out of our control such as natural disasters, industrial disputes, reason of threat or war, riots, civil strife, terrorist activities, technical problems to the transport, extreme weather conditions, closure of the airports and sea ports and similar event out of our control, or are due to unusual and unforeseeable circumstances beyond your control. PUNCTUALITY The drivers are bound by restrictions concerning maximum driving hours per day and per week, and the itineraries are planned having regard to the same. It is, therefore, essential that the itineraries, schedules and timings are strictly adhered to by the Clients so as to ensure that all the services can be duly provided. If the Client misses any service due to unpunctuality, there shall be no refund for the same. LAW & JURISDICTION Law prevalent in India is applicable and as a part of the cause of action arises in Bhubaneswar and the Company has its Registered Office in Bhubaneswar, it is agreed between the parties that in the event of a dispute or difference between the parties, the exclusive jurisdiction shall vest in court / forum / tribunal in Bhubaneswar alone having jurisdiction to decide the matter. THE CLIENT DECLARATION On behalf of all the persons named in the Booking Form, I/we have read the Terms and Conditions and Booking Conditions and have understood the How to Book rules, a copy of which has been furnished to me/us. I/We being the said person/s duly authorised, do hereby agree to and accept the same for Self and others.
